The privacy and confidentiality of your health information is secured by various state and federal laws, notably the Health Insurance Portability and Accountability Act (HIPAA). The University of Miami UHealth Privacy Office has the responsibility for assuring compliance with these laws and the associated regulations, for all health information maintained by the University’s hospitals and clinics.

In general, the HIPAA regulation and Florida medical privacy laws require that we preserve the privacy and confidentiality of your health information, and restrict uses and disclosures of your information to those serving legitimate health-related purposes. As patients, the laws also provide you with certain rights with respect to your health information.

What is the 21st Century Cures Act’s Information Blocking Rule? Page 1

The 21st Century Cures Act is a federal law designed to help patients quickly and easily access their electronic health information to make informed decisions about their care. The Cures Act requires healthcare organizations, like the University of Miami Health System (“UHealth”), to make electronic health information, such as clinical notes and test results, available to patients upon request without unreasonable delay.

What does my doctor have to do? Page 1

This law requires your doctor to release certain protected health information, such as final test results, to you without unreasonable delay. There are certain exceptions to the rule. Not all test results will be available to you immediately. We believe sharing this information with you will:

  • Improve your trust in your doctor.
  • Make it easier for you to participate in your care.
  • Support shared decision-making with you and your doctor.
  • Help you use health services correctly.

Your doctor will now share certain information with you via your patient portal, My UHealth Chart, at https://umiamihealth.org/myuhealthchart. You also have the right to request to receive your information in other formats. We will talk with you about what is the best way to get you your information. When will I receive my test results? Page 1

You may see your results before your doctor has a chance to review them. These notes and test results may be hard to understand. Your doctor will contact you about your results to discuss them as needed. If you have concerns about your results or have not heard from your doctor’s office after 3 days, please contact them.

In line with the 21st Century Cures Act, most test results will appear in your patient portal, MyUHealthChart, as soon as they are final. There are certain exceptions to the rule. Not all test results will be on your portal right away. If you do not want to see your final test results on your MyUHealthChart account before your doctor reviews them, ask your doctor to delay release of your results. Your doctor will contact you after reviewing your test results.

Should I wait to look at my results until after I’ve heard from my doctor? Page 1

With this new law, you can now decide when is the best time to see your results. You can choose to view them on your patient portal as soon as they are ready, or you could wait until your doctor's office contacts you. Please talk with your doctors when they order your tests about what is the best plan for you. Some patients prefer to wait to hear from their doctor first for results that could be life-changing, like a biopsy.

What if I don’t understand what my physician put in my visit note? Page 1

It is common for doctors to use medical terms in your visit note which you may not know. Our goal is to always discuss any confusing or concerning information during your next scheduled visit. We understand that you may want questions answered sooner. The following websites may help you find definitions of medical terms and abbreviations.

We encourage you to contact your doctor using MyUHealthChart by sending a message. You can also call your doctor's office with any questions you have about the information in your notes.

I received a test result that I’m concerned about. What should I do? Page 1

We believe in being upfront about your information. We also believe you deserve to see your information as soon as possible. This means you may see some results even before we do. We do look at every test result, and your doctor will contact you if you need a follow-up visit or test. You may also contact your physician via MyUHealthChart or call to ask any questions or discuss your concerns. You may have tests that show abnormal results but are not concerning for your overall health. For other results, your doctor may need to review your other tests and information in your chart. Sometimes it is better if you and your doctor discuss these test results in person. Our goal is to do just that at your next scheduled visit.

Knowing this, if you still have an immediate concern, you can send your doctor a message via MyUHealthChart or call to discuss.

Can I change MyChart notifications, so I don’t get an email when test results are posted in my account? Page 1

Yes. To do this, go to the MyChart home page and click “Menu.” A menu list will appear on your screen. Scroll down to the “Account Settings” section at the bottom. Select “Communication Preferences.” Notification settings are shown with email, text message, phone call, and mail icons. If the notification setting is active, the icon for your chosen option will be green. If a notification setting is not active, the same icon will be white. To change your push notification settings for test results, click the drop-down menu for “Health” and click on the icon for how you would like to know that your results are ready. If you do not want to receive any notifications that your test results are available, click the icon(s) so that it turns white. Be sure to save your changes when you are done making your selections.

What can I do if I feel a doctor has made an error in a note or if there is an error with a result? Page 1

You have a right to request that any protected health information (“PHI”) about yourself that is maintained by UHealth be amended for as long as your patient record is maintained. You can submit an amendment request by emailing the Privacy Office at Privacy@med.miami.edu or calling 305-243-5000.
